A New York state jury has rendered a verdict awarding $15 million to the family of Munir Seen, a construction worker who succumbed to mesothelioma in 2019. The jury found Kaiser Gypsum Co. Inc. negligent, acting with reckless disregard for safety by selling a joint compound containing asbestos.
Verdict Delivered After Lengthy Trial
Following a three-week trial, the jury reached its decision on Friday, as announced by attorneys representing the Seen family. Munir Seen, aged 69 at the time of his passing, worked in construction in New York and New Jersey during the 1960s to the 1980s. The lawsuit alleged that exposure to asbestos in Kaiser Gypsum’s joint compound led to his mesothelioma diagnosis in 2016.
The lawsuit highlighted Kaiser Gypsum’s joint compound instructions, which involved sanding the product, leading to the generation of asbestos-laden dust. Seen’s diagnosis of mesothelioma was preceded by symptoms of shortness of breath, prompting legal action before his demise in 2019.
Daniel P. Blouin of Simmons Hanly Conroy, representing the Seen family, emphasized Mr. Seen’s dedication to his family and the pursuit of the American dream. While acknowledging that no monetary compensation could bring back Mr. Munir, Blouin commended the jury’s verdict as just and based on compelling evidence.
